terms and conditions: i.) MR Studio shall not be responsible for any loss of recording quality due to mobile phone/radio/television/electrical interference and/or any other noise pollutant existing in the public domain, e.g. cars, planes, trains, weather, crowds/people, animals/wildlife, alarms/sirens, building/roadworks, inferior mains wiring, plumbing e.t.c. ii.) Any assessment of the suitability of the recording environment is to facilitate the sound engineers decision that a professional quality recording is probable by MR Studio and the standard it adheres to. iii.) Multi-track masters can be purchased. However, as it is often practice to re-use recordable hard-drives, MR Studio advises the client to discuss any purchase/back-up/archiving of the material (in its multi-track form) early on, as it will not guarantee the longevity of the recording upon completion of the pre-determined audio mixing process. MR Studio will keep any non-purchased multi-track recordings for as long as possible before deleting them for recycling. iv.) In the case of an on-going or incomplete recording project, it will be expected that the client purchase the master multi-track and/or any archived material before commencement of any future work being carried out. It is also expected that the client, in an on-going or incomplete recording project scenario, will pay for any services rendered by MR Studio before commencement of any further work being carried out. Payment will become due on the date the client receives the services of MR Studio. Overdue/late payments will incur interest and administration charges under "the late payment of commercial debts (interest) act 1998." v.) All recordings will remain the property of MR Studio until paid for in full by the client. vi.) Any actions taken by the client, on any advice given by MR Studio, shall be the sole responsibility of the client. All advice is given in good faith. vii.) MR Studio reserves the right to refuse trade for any reason, either paid or complimentary. viii.) It will solely be the clients responsibility to seek any permission required to use, and for MR Studio to have access to, the recording environment. ix.) MR Studio hopes for a happy and friendly working atmosphere and relationship with all its clients. If, at any time during the relationship, the client is unhappy with the service provided by MR Studio or would like to offer advice on how the services of MR Studio could be improved or expanded, or would like to offer appraisal of services received, MR Studio welcomes any constructive criticism in writing, sent to: MR Studio, 18, Liverpool, L12 0JU, UK. x.) Any wilfull damage, made by the client, to the property of MR Studio, including any act construed as artistic expression, will result in termination of the contract. Equipment replacement costs, and any monies owed to MR Studio for services received by the client, including reimbursment for any business lost by MR Studio, due to the inability to deliver its services, brought on by the absence of the aforementioned damaged equipment in MR Studio's inventory, will be added to the clients final bill. xi.) MR Studio shall endeavour to meet any product delivery deadlines specified by the client, however MR Studio cannot guarantee or warrant that the product delivery deadline will be met, and will not become liable for any damages as a result of this deadline not being met. xii.) The client undertakes, warrants and represents to ensure that no materials will contain any libellous, blasphemous, obscene or other offensive or illegal material and furthermore, the client undertakes, warrants and represents, and holds MR Studio free and harmless with respect to any claim for damages, costs and expenses (including legal fees) incurred by MR Studio in relation to the aforesaid material. The client undertakes to pay in full any sums due in relation to the aforesaid material in event of seizure or restraint. xiii.) The client undertakes, warrants and represents to ensure that no unauthorised use of copywritten work is used in any materials. When copyright exists it is the clients responsibility to seek the permission of the lawful copyright owner to grant legal use of such material. The client undertakes, warrants and represents, and holds MR Studio free and harmless with respect to any claim for damages, costs and expenses (including legal fees) incurred by MR Studio in relation to the aforesaid material. The client undertakes to pay in full any sums due in relation to the aforesaid material in event of seizure or restraint. xiv.) All prices subject to change without prior notice. 15% non-refundable deposit required on all bookings. 50% of payment required on day of recording, 100% required upon completion of work. We will not release completed work until payment has reached our account. xv.) For the health, wellbeing, longevity and quality of: the client, MR Studio's staff, and MR Studio's equipment, MR Studio always operate a no smoking policy. The client will be responsible for any damage to equipment due to failure to adhere to the no smoking policy. It is also the clients responsibility to ensure smoking is prohibited at publicly recorded events. xvi.) All images and text on this website remain the property of ©2002-2008 www.mrstudio.biz. All rights reserved. All content, designs, text, graphics, underlying source codes, and other arrangements on this site are the copyright of MR Studio. Permission is granted to users to download and print one copy of this site for their own personal, non-commercial use. Any other use of this site without prior written consent from MR Studio is strictly prohibited. xvii.) Mr Studio does not accept responsibility for mistakes or errors in text and artwork, it is up to the client to inspect a proof copy before production. xviii.) It is the clients responsibility when posting artwork, compact discs, DAT tapes or other works, to insure their property in transit. MR Studio can not be held responsible for property that goes missing or arrives damaged or incomplete. The client should back-up/duplicate any works before posting/delivering. xix.) The clients acceptance of MR Studio's discounted services gives MR Studio the exclusive right to include its logo and name, and any of its associated logos and names on all CD cover and CD body artwork. Specifications for logo sizes are available from MR Studio on request, the client must adhere to these strict guidelines. xx.) Care is taken that all information displayed on this website is correct and up to date. However, MR Studio cannot be held accountable for any mistakes that occur. xxi.) Materials cannot be used as templates by other individuals, companies or organisations. If an individual, company or organisation wishes to use any of our, or our client's "material" in this way written permission must be obtained from "MR Studio" authorising this action. In addition, an appropriate fee must be negotiated for the process. Legal action will be taken against those individuals, companies and organisations who do not adhere to this clause, which may result in legal/administrative recompense in addition to a royalty settlement. xxii.) Sanity Clause-everybody knows there is no such thing as a Sanity Clause. terms last revised: 17th July 2007. Client The hiring party/prospective hiring party and any of its employees, contractors or associates receiving or planning to receive the services of MR Studio. Services Any advice, trade or goods offered by, or received from MR Studio, either paid, unpaid or complimentary. Recording environment Any place or venue where MR Studio will, or believes it will, carry out its trade with the client.
